JUDGMENT OF THE VALUATION TRIBUNAL
ISSUED ON THE 7th DAY OF NOVEMBER, 2000

By Notice of Appeal dated the 14th October 1996, the appellants appealed against the determination of Cork Corporation in fixing a market value of £10,000 on the above described site under Section 22 (1) of the Derelict Sites Act, 1990.

The Appeal proceeded by way of an oral hearing which tool place in County Hall, Carrigrohane Road, Cork on the 3rd day of November 2000. The Appellant represented himself and the Respondent was represented by Mr. Martin Fagan ASCS ARICS, from the Property Department of Cork Corporation.

Property
The property consists of a site of approximately 28m2 at Meade Street within the commercial area of Cork City centre.

Appellant's Valuation
The appellant said in evidence that he put no valuation on the site and that he would be quite willing to hand the site over to Cork Corporation without charge.

Respondent's Valuation
The Corporation's Valuation is based on its facility for parking in the city centre comprising two spaces @ £5,000 per space = £10,000.

Determination
The Tribunal has carefully considered all the evidence and all the submissions made in relation to this appeal. The Tribunal noted with interest the appellant's comments regarding the history of this site. Nonetheless the Tribunal has to accept that it is a derelict site having been placed on the register of derelict sites by Cork Corporation and having remained thereon to the date of this hearing. In accordance with Section 22 of the Derelict Sites Act the Tribunal must proceed to put a value on it. Having regard to the state of the property and its size and all the other evidence that was given to us, the Tribunal determines that the valuation attributed to the site by Cork Corporation of £10,000 in all the circumstances is fair and reasonable and is hereby affirmed.
